2. The petitioner has prayed for bail in a case registered for the offence punishable under section 302 of the Indian Penal Code and section 27 of the Arms Act.

3. As per allegation in the FIR, nephew of the informant has received fire arm injury and during treatment at PMCH, Patna, he died.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. FIR is against unknown. On suspicion, four accused persons were arrested by the police who has not taken the name of the petitioner but one scooty which was used in the crime, was

Patna High Court CR. MISC. No.84190 of 2023(3) dt.01-02-2024 2/2 recovered from their possession and also they disclosed the name of Suraj Kumar, and thereafter Suraj Kumar disclosed the name of Bilaal, who is the main assailant. Petitioner is languishing in judicial custody since 8.8.2023.

The application for bail is opposed by learned APP for the State and learned counsel for the informant and submitted that petitioner has hired accused Billal as supari killer, who has committed murder of the deceased and he received Rs. 6,00,000/- from the petitioner. Petitioner is the kingpin the alleged murder.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with Kadamkuan P.S. Case No. 442 of 2023.
