2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 447, 504, 326, 307, 387, 323 , 506 and 34 of the Indian Penal Code .
3. As per the prosecution case , petitioner No. 1 made indiscriminate firing on father-in-law of the informant and there is no allegation of overt act against petitioner No. 2.
4. It is submitted on behalf of the petitioners that though there is allegation against petitioner No. 1 that he made 7 round gunshot fire but no one sustained injury. So far as,
Patna High Court CR. MISC. No.83638 of 2023(3) dt.19-03-2024 2/2 petitioner No. 2 is concerned, there is no allegation of any overt against him.
5. Learned counsel for the State as well as Opposite party No. 2 oppose the bail petition.
6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Khagaria in connection with Parbatta P.S. Case No. 352 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure . (Prabhat Kumar Singh, J) Koushik/- U T
