The petitioner, who is the President of Ward No. 13 of village Jhinguri under the Gram Panchayat Koilwa, seeks bail in connection with Pauthu P.S. Case No. 31 of 2019 dated 11.06.2019 instituted for the offence under Sections 409 and 420 of the Indian Penal Code.

The accusation in the FIR is of not having completed fully the work of providing drinking water to all the homes in the ward. As such, an allegation has been levelled that the petitioner and the other functionaries of the Panchayat have pocketed the money which was meant to be spent on the aforesaid project. No.72750 of 2019(2) dt.04-12-2019 2/2 advocate for the petitioner has submitted that from the own showing in the FIR, most of the work which was required to be executed had been performed. For the left-over work, some time was sought by the petitioner and another but instead of extending time, the subject FIR has been lodged.

Regard being had to the aforesaid fact and taking into account the gender of the petitioner as also her period of custody, she is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Aurangabad in connection with Pauthu P.S. Case No. 31 of 2019.
