2. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 352, 109(1), 74, 303(2) and 3(5) of B.N.S., 2023.

Learned counsel for the petitioners submits that petitioner no.1 has antecedent of four cases, petitioner no.2 has antecedent of two cases and petitioner no.3 has antecedent of one case and petitioner no.3 is a woman and the informant alleges that on 13.07.2025 at 05:00 p.m., he was going by his

No.79801 of 2025(2) dt.08-12-2025 2/3 motorcycle when he was intercepted by 7 named accused persons including the petitioners, the accused abused and assaulted him by lathi, rod and farsa causing injury on head, thereafter, they also assaulted his brother and Bhabhi who came to save him causing injury on their hand, back and head.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that informant and petitioners are neighbours and are having dispute relating to passage. It is further submitted that from side of the petitioners, Rivilganj P.S. Case No.228 of 2025 was instituted against the informant and his side, as such, the instant FIR is a counter blast. It is also submitted that no doubt petitioners have antecedent but the nature of allegations as alleged in the FIR also needs to be appreciated. It is reiterated and submitted that no specific allegation of assault is alleged against the petitioners. It is also submitted that petitioners will not abscond rather will co-operate in the investigation to prove their innocence.

5. Learned APP for the State opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioners, let petitioners, above-named, in the

No.79801 of 2025(2) dt.08-12-2025 3/3 event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Rivilganj P.S. Case No.229 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. (Satyavrat Verma, J) Sanjay/- U T
