2. The petitioner seeks regular bail in connection with Tajpur P.S. Case No. 342 of 1996 registered for the offence under Section(s) 447, 364, 5111, 307, 120B, 302 of the Indian Penal Code and Section 27of the Arms Act.

3. The allegation against the unknown criminals is of having fired upon the deceased. Subsequently, during the investigation, the name of the petitioner has come but from the impugned order it appears that the case diary etc., is not available.

4. The petitioner is only suspected of having participated in the crime. He is now 70 years old and is in

5. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

6. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Tajpur P.S. Case No. 342 of 1996 subject to conditions that:- (I). Till the framing of charge, the petitioner shall appear physically in the trial and after framing of charge, the petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.
