JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2020 This is an application for grant of anticipatory bail in connection with Tariyani P. S. Case No. 173 of 2019, disclosing offences under Sections 30(a) and 37(c) of the Bihar Prohibition and Excise Act, 2016.
There is allegation against the petitioner that he was engaged in the sale of liquor, police raided the place and found several persons at the shop inebriated condition and also recovered 40 liters of liquor from the shop.
Submission of the learned counsel for the petitioner is that the shop does not belong to the petitioner. He has no criminal antecedent.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that there is recovery from his shop and the submission of learned counsel for the petitioner
Patna High Court CR. MISC. No.72269 of 2019(2) dt.17-01-2020 2/2 that shop does not belong to the petitioner, it cannot be tested at present.
Having heard both sides, in view of the allegation and the quantity of the liquor recovered from the shop of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by this order.
