2. The petitioner apprehends his arrest in connection with Barahara P.S. Case No. 253 of 2024 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, total 43.2 litres of illicit foreign liquor and 90 litres of country made liquor have been recovered from the motorcycle.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is not the owner of the seized motorcycle and he has clean antecedent.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts of the case, this application for anticipatory bail is allowed.

7. Let the petitioner above named, in the event of arrest or surrender before the Court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 1st Bhojpur at Ara in connection with Barahara P.S. Case No. 253 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

8. The petitioner shall deposit an amount of Rs. 40,000/- (Rupees Fourty Thousand Only) in Ramkrishna Mission Ashrama, Nala Road, Patna and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.
