Petitioner, already in custody, seeks bail in connection with Kasim Bazar P.S. Case No.153 of 2016, corresponding to Session Case No.244 of 2017 registered under Sections 302/34/120(B) of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that the informant's son was ambushed by FIR named accused persons in a cinema hall premises. Allegation is that all made indiscriminate firing causing his death at the spot.

Learned counsel for the petitioner submits that the son of the informant was a notorious criminal carrying criminal antecedents of serious nature and was killed in gang war, the

No.39099 of 2018(2) dt.05-07-2018 2/2 petitioner has no criminal antecedent, there is omnibus accusation against all FIR named accused persons including the petitioner and some of the accused persons named in the FIR have been admitted to bail by co-ordinate Benches of this Court vide Cr. Misc. No.32305 of 2018 and Cr. Misc. No.27718 of 2018.

Having considered the aforesaid facts and circumstances, the general and omnibus allegation and principle of parity, petitioner Chintu Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Munger in connection with Kasim Bazar P.S. Case No.153 of 2016, corresponding to S.C. No.244 of 2017.
