JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-12-2019 The petitioner seeks bail in anticipation of his arrest in connection with Matihani P.S. Case No. 96 of 2019 dated 19.06.2019 instituted for the offences under Sections 341, 323, 307, 354(B), 504, 506, 379/34 of the Indian Penal Code.

The petitioner and his entire family members are alleged to have assaulted the informant and his family members because of some family dispute.

Admittedly the petitioner is an agnate of the informant. The injury suffered by the informant is stated to be simple in nature which is evident from Annexure-2 of the petition.

Patna High Court CR. MISC. No.72558 of 2019(2) dt.11-12-2019 2/2 Considering the nature of accusation against the petitioner and the existence of background enmity with respect to a dispute over a plot of land, this Court is inclined to grant bail to the petitioner.

The petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Matihani P.S. Case No. 96 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
