The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in a case instituted for the offences under Sections 420, 379 of the Indian Penal Code and 135 of the Electricity Rules.
The prosecution case in short is that in a raid conducted by the Department, the petitioner was found involved in theft of electricity due to which the Department suffered huge loss.
Patna High Court CR. MISC. No.75784 of 2019(4) dt.09-09-2020 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.9.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. As per the allegation, the petitioner is said to have committed theft of electricity. A supplementary affidavit has been filed on behalf of the petitioner in which he has stated that after reassessment, Rs. 4,659/- along with Rs. 4,000/- (compounding charge) has been imposed upon the petitioner and the said amount have already been deposited by the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Ranjan, J.M. 1st Class, Begusarai in connection with Nawkothi P.S. Case No. 78/19.
