Petitioner seeks bail in Pakaridayal P.S. Case No.69 of 2003 registered under Sections 447, 307, 504 and 34 of the IPC and under sections 25(1-b)a, 26 and 27 of the Arms Act. The petitioner was on bail but the bail bond of the petitioner was cancelled on 06.11.2008 and warrant of arrest was issued against the petitioner on 26.08.2008. Learned counsel for the petitioner submits that the case is registered under section 307 of the I.P.C. and compromise petition has also been filed. The petitioner surrendered in the court on 18.10.2019 and since then he is in custody. The petitioner has already remained in jail for more than one month for misuse of privilege of bail.

No.75355 of 2019(2) dt.26-11-2019 2/2 Having considered the facts aforesaid, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned 3rd A.D.J., Motihari, East Champaran in connection with Pakaridayal P.S. Case No.69 of 2003 subject to the condition that the petitioner shall appear in Court on each and every date during pendency of the trial save and except on the ground of unavoidable reason.
