The petitioner apprehends his arrest in Aurangabad (Town) P.S. Case No. 94/2018, registered for the offences punishable under Sections 307, 147, 148, 149, 504, 436, 427, 160, 295(A), 353 of the Indian Penal Code.

The informant named many persons in the F.I.R. and alleged that they were taking procession on the eve of Ramnavmi. The processionist ran amok and set ablaze the shops. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The brother of the petitioner had gone to market with the motorcycle of the petitioner. The motorcycle was seized from the market. The petitioner has falsely been implicated

Patna High Court Cr.Misc. No.39670 of 2018 (2) dt.10-07-2018 2/2 in the case. Nobody was injured. Similarly, situated other accused persons have already been granted either regular bail or anticipatory bail.

Considering the facts aforesaid and the fact that petitioner is not named in the F.I.R. name of the petitioner came only on the basis of recovery of the motorcycle owned by the petitioner, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S. Case No. 94/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
