JUSTICE NANI TAGIA ORAL ORDER 27-06-2025 This contempt petition has been filed alleging violation of the order dated 21.12.2018 passed in C.W.J.C. No. 10334 of 2015, in which writ petition it was directed that the petitioner be treated to have been promoted notionally on the post of Deputy Superintendent of Police from the date of grant of approval by the Hon'ble Chief Minister. 26.02.2013 is stated to be the date on which the Hon'ble Chief Minister had granted

2. Opposite Party Nos. 1 and 2 have filed the show cause, wherein, in paragraph No. 5 it has been stated that the committee under the chairmanship of the Chief Secretary, Bihar held on 24.04.2023 has recommended granting of notional promotion to the petitioner on the post of Senior Deputy Superintendent of Police with effect from 28.02.2013 subject to the condition that the aforesaid promotion will be subject to the outcome of L.P.A. No. 348 of 2023, in which L.P.A. the direction given in the writ petition has been put to challenge by the State. The said recommendation has also been enclosed as Annexure A to the show cause.

Though the direction issued in the writ petition was to treat the petitioner to have been promoted notionally on the post of Deputy Superintendent of Police from the date of grant of approval of the Hon'ble Chief Minister on 26.02.2013, since the petitioner has been granted promotion on the post of Senior Deputy Superintendent of Police, which is higher in the rank of Deputy Superintendent of Police with effect from 28.02.2013 subject to outcome of L.P.A. No. 348 of 2023, I find that the order dated 21.12.2018 passed in C.W.J.C. No. 10334 of 2015 has been complied with by the Opposite Parties.

4. Accordingly, the contempt petition stands closed and disposed of.
