2. The petitioner seeks bail in connection with Rupauli (Mohanpur O.P.) P.S. Case No. 272 of 2023 registered for the offence punishable under Sections 25(1-b)a, 26(1) of the Arms Act.

3. This is the second attempt of the petitioner for grant of bail. Earlier his application was rejected vide order dated 04.04.2024 passed in Cr. Misc. No. 23056 of 2024.

4. The petitioner is in jail since 31.10.2023 for recovery of a countrymade rifle from the house of the petitioner.

5. It has been submitted by the learned counsel for the petitioner that there has been no progress in the trial and he claims to have clean antecedent.

6. Learned Additional Public Prosecutor appearing on

Patna High Court CR. MISC. No.85636 of 2024(2) dt.08-01-2025 2/2 behalf of the State has vehemently opposed the prayer for bail.

7. Considering the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Purnea/ concerned court in connection with Mohanpur O.P. P.S. Case No. 272 of 2023.

8. At the time of furnishing bail bonds, the trial court will verify the antecedent of the petitioner and will accept the bail bond if he has clean antecedent. If any case is found against him, his bail bonds shall not be accepted.

9. During the pendency of this case, the petitioner will mark his attendance in Mohanpur police station in the district of Purnea on every Sunday.
