JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 31 of 2018 registered for the offences punishable under Sections 420 and 468 of the Indian Penal Code.

As per complaint case petitioner sold a piece of land to the complainant and petitioner got possession of the land on the plea that he will cultivate the land and pay Rs.11,000/- to the complainant per year and he has given the said money for one year but later on he refused to pay the amount and later on complainant came to know that he has sold the land to some other person.

Submission of learned counsel for the petitioner is

Patna High Court CR. MISC. No.72694 of 2019(2) dt.18-11-2019 2/2 that whole allegation is false and concocted and petitioner has not sold the land and land is still in his name and he has paid rent to the State of Bihar, which will appear from Annexure-2. Heard learned APP also.

In view of above facts and circumstances, let petitioner surrender and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Bikramganj, Rohtas, in connection with Complaint Case No. 31 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that petitioner has to co-operate in disposal of the complaint case.
