JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Atri P.S. Case No. 201 of 2017 for the offence under Sections 272/273 of the Indian Penal Code and Sections 30(a)(d) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case 200 litres Mahua liquor was seized. Learned counsel further submits that nothing was recovered from the conscious possession of the petitioner and the petitioner has got no criminal antecedent. The petitioner is in custody since 15.05.2018. Considering the fact that the petitioner has remained in custody for nearly two months and he has no criminal antecedent, the petitioner, named above, is directed to be released

Patna High Court Cr.Misc. No.40315 of 2018 (2) dt.10-07-2018 2/2 on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Gaya in connection with Atri P.S. Case No. 201 of 2017.
