JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Rajpur P.S. Case No. 115 of 2018 for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent, he is the owner of the said vehicle but he has no knowledge about the cartoon which was loaded in the said vehicle and as such he has made accused in the instant case, nothing has been recovered from the possession of the petitioner. Petitioner is in custody since 02.06.2018. Considering the fact that the petitioner has no criminal antecedent and nothing has been recovered from the possession of the petitioner, let the petitioner is directed to be released on
Patna High Court Cr.Misc.
