This application for regular bail arises out of Kotwali P.S. Case No. 77 of 2019, disclosing offences punishable under Sections 394 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is in custody since 27.06.2019. The F.I.R. was registered against unknown with the allegation that on 21.02.2019, when the informant was going to Railway Station, he was surrounded by three persons, who snatched from him cash of Rs. 14,000/- and a mobile phone. It is further alleged that when the informant raised alarm, one of them fired, which caused firearm injury in the informant's hand. The petitioner was arrested on 12.03.2019, in connection with another criminal case registered as Kotwali P.S.

Patna High Court CR. MISC. No.75571 of 2019(4) dt.18-06-2020 2/2 Case No. 126 of 2019. During his arrest in the said case, the petitioner has been remanded in other cases also, including the present one.

Case Diary has been called for, which have been perused. The police have referred to materials collected from the CCTV footage in the Case Diary. However, there is no material in the case diary to suggest that it was the petitioner, who had also participated in commission of the offence. The accusation is based on secretly received information.

Considering the materials, which have surfaced in the case diary, in my opinion case for grant of regular bail is made out.

This application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Kotwali P.S. Case No. 77 of 2019.
