The petitioner seeks bail in Bausi P.S. Case No. 100 of 2017 registered for the offence punishable under Sections 8/20(b)(ii) of NDPS Act.
Informant is the Assistant Sub Inspector of Police who in his written complaint has stated that while he was on patrolling duty on 30.08.2017 at about 5:45 pm he stopped a Tempo for search and two persons sitting on the Tempo fled away after leaving two bags and on search it was found that both bags contained 2.5 Kg and 3 Kg of intoxicating materials and the same were seized in presence of witnesses. During investigation it was found that the said bags belonged to Vinod Singh and petitioner-Ganga Prasad.

No.39910 of 2018( 2) dt.12-07-2018 2/2 It has been submitted on behalf of the petitioner that the petitioner has been implicated in this case only on suspicion and there is no incriminating material against him to implicate him in this case. It has been further submitted that the seized material has not been sent to FSL to verify as to what type of intoxicating material it is. Petitioner has got no criminal antecedent and is in custody since 10.05.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge cum Sessions Judge, Araria, in connection with Bousi P.S. Case No. 100 of 2017.
