1. Heard learned counsel for the petitioner and learned A.P.P. for the State, Mr. Chandra Bhushan Prasad.
2. The petitioner apprehends his arrest in connection with Sachiwalaya P.S. Case No. 129 of 2025 registered for the offences punishable under Sections 126(2), 115, 109, 329(4) and 3(5) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that on 15.06.2025, seven named accused persons including the petitioner entered his house at 08:00 PM and assaulted his two brothers by rod causing injury on head, while Bhola assaulted his aunt by knife causing injury on hand requiring six stitches.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the
Patna High Court CR. MISC. No.78697 of 2025(2) dt.04-12-2025 2/2 informant, it is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that allegation of assault is general and omnibus in nature. It is further submitted that as far as allegation of assaulting the aunt of informant is alleged by knife, the same is against Bhola, as such, against the petitioner no specific allegation of assault is alleged.

Learned A.P.P. for the State vehemently opposes the anticipatory bail application and submits that no doubt allegation of assault is not specific, but then Bhola is alleged to have assaulted his aunt by knife which required six stitches and the presence of the accused persons including the petitioner at the place emboldened Bhola to commit the occurrence. It is also submitted that investigation of the case is in its nascent stages.
6. Considering the submissions made by the learned APP for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.
7. Accordingly, the instant anticipatory bail application stands rejected.
