The petitioner seeks bail in connection with Ahiyapur P.S. Case No. 12 of 2019 dated 03.01.2019 instituted for the offence under Section 392 of the Indian Penal Code.

It has been submitted that the petitioner was arrested in a case of similar nature vide Ahiyapur P.S. Case No. 35 of 2019 and has been remanded in the present case on suspicion. Even though he is in custody since 05.03.2019 but has not been put on test identification parade. There is no recovery of any looted article.

Considering the aforestated facts, viz. the accusation of the petitioner being on suspicion and his

Patna High Court CR. MISC. No.72407 of 2019(2) dt.04-12-2019 2/2 period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 12 of 2019.
