Petitioner, already in custody, seeks bail in connection with Nagar P.S. Case No.188 of 2018 registered under Sections 379 and 461 of the Indian Penal Code.

Allegation in brief is that in the night theft was committed in the shop of the informant, cash and other articles were stolen and in the CCTV installed in the shop Chandan Paswan was identified as one of the miscreants entering into the shop.

Learned counsel for the petitioner submits that the petitioner was apprehended on the basis of confessional statement of Chandan Paswan and Rs.21,900/-, which was

Patna High Court Cr.Misc. No.39080 of 2018(2) dt.05-07-2018 2/2 recovered from the house of the petitioner is his personal money.

Having considered the aforesaid facts and circumstances, petitioner Mithu Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Nagar P.S. Case No.188 of 2018.
