The petitioner, who is in custody since 06.10.2019 and has clean antecedent, seeks bail in connection with Special Case No. 8853 of 2019, arising out of Bihta P.S. Case No. 920 of 2019 dated 04.10.2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

135 litres of liquor is said to have been recovered from a vehicle which was being driven by the petitioner. The occupants of the vehicle fled away on seeing the police. The petitioner claims to be the driver of the vehicle.

It has been submitted that the consignment of

Patna High Court CR. MISC. No.72747 of 2019(2) dt.04-12-2019 2/2 liquor may have belonged to the persons who had managed to escape.

Considering the aforestated facts and especially the clean antecedent of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge-Excise Act, Patna in connection with Special Case No. 8853 of 2019, arising out of Bihta P.S. Case No. 920 of 2019.
