The petitioner seeks bail in connection with Buniyadganj P.S. Case No. 68 of 2019 dated 04.05.2019 instituted for the offence under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

From the perusal of the FIR it appears that the deceased is the son of the informant and whose murder was reported to him by another son viz. Ajay Rai. The FIR specifically refers to the names of four of the accused persons and about 5 - 6 unknown accused persons. The surviving son of the informant has informed the informant that while coming back home, he heard the sound of firing and on reaching the place of

While fleeing away, he saw some persons who have been named in the FIR. In the statement of the son of the informant who claims to be an eye witness to some part of the occurrence, the name of the petitioner has though transpired, but in a vague and general manner.

Though the petitioner has been made accused in three different cases earlier but in all such cases he is on bail.

Regard being had to the facts that there is no specific accusation against the petitioner and his name has transpired in the statement of one of the brothers of the deceased who has not attributed anything in particular against the petitioner and the period of custody which is from 08.07.2019, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, VIII, Gaya in connection with Buniyadganj P.S.
