JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with S.T. Excise Caste No.443 of 2018 (Jadiya P.s. case no. 92 of 2018) for the offence under Section 30(a) of the Bihar Prohibition of Liquor and Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case 243 litres liquor was seized. He submits that the petitioner has got no criminal antecedent. The petitioner is in custody since 31.05.2018. Learned counsel further submits that the petitioner is the driver of the vehicle and plying the vehicle as per direction of the owner of the vehicle. He submits that the petitioner was not aware that liquor was kept inside the vehicle. Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for more than

Excise No.443 of 2018 (Jadiya P.S. Case No. 92 of 2018).
