JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-12-2019 The petitioner seeks regular bail in connection with Kargahar P.S. Case No.388 of 2018, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 224.640 litres of country made wine from the vehicle and petitioner is said to be identified in fleeing away.

Submission of learned counsel for the petitioner is that he is under custody more than three months and charge sheet has been submitted.

Heard learned A.P.P. opposed the prayer and submitted that petitioner has got criminal antecedent and having three other cases also.

No.77912 of 2019(3) dt.09-12-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, nature of allegation and has remained in custody for about three months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge Excise, Rohtas, Sasaram in connection with Kargahar P.S. Case No.388 of 2018. It is made clear that if the petitioner again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of his bail bonds.
