2. The petitioners apprehend arrest in connection with Complaint Case No. 831 of 2023 dated 02.08.2023 instituted for the offence punishable under Sections 420, 465, 468/34 of the Indian Penal Code.
3. The prosecution case, in short, is that co-accused Roop Lal Uraon used to cultivate the land of the complainant on Batai. He got executed the said land in his favour through forged and fabricated sale deed by impersonating another person in place of the husband of the complainant. Allegation against
Patna High Court CR. MISC. No.83181 of 2023(2) dt.10-01-2024 2/3 the petitioners is that they are the witness and identifier of the said forged sale deed.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is further submitted that the entire allegation are against co-accused Roop Lal Uraon, who was the purchaser of the land, in question, through sale deed executed on 05.03.2019 in which the petitioner no. 1 is the witness and petitioner no. 2 is the identifier. Learned counsel for the petitioner submits that keeping in view the aforesaid facts of the case, the allegations against the petitioners are civil in nature. Lastly, it has been submitted that petitioners have no criminal antecedents.
5. Learned A.P.P. has opposed the prayer for anticipatory bail of the petitioners.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with Complaint Case No. 831 of 2023, they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnia subject to
