2. The petitioner has prayed for bail in a case registered for the offence punishable under Section 379 of the I.P.C.
3. The case of the prosecution is that one bike was stolen by unknown miscreants. It is further alleged that during investigation the bike was recovered from the possession of the petitioner.
4. Learned counsel appearing on behalf of the petitioner has submitted that for recovery a separate case has been filed against the petitioner. In this case the petitioner is in custody since 24.06.2024.

5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering that since there is only one occurrence i.e. of stealing of bike and when bike is recovered, a separate case has been filed. In my view there should be only one case. Considering the above facts and circumstances, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of A.C.J.M.-4, West, Muzaffarpur in connection with Saraiya P.S. Case No. 148 of 2024.
7. Accordingly, the present bail application stands allowed.
