Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 366A and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant with an allegation that he along with other accused kidnapped the minor daughter of the informant. It is next submitted that the victim came back and her statement was recorded under Section 164 Cr.P.C. (Annexure2), wherein she disclosed her age as 18 years and has not supported the case of the prosecution, rather has stated that her parents intended to get her married with an aged person, as such, she on her own

Patna High Court CR. MISC. No.83126 of 2024(2) dt.24-01-2025 2/2 volition went with the petitioner and they have performed their marriage. The learned counsel next submits that out of the wedlock, a child was born and the petitioner is in custody since 10-9-2024 and charge-sheet has been submitted as such no useful purpose will be served by keeping the petitioner behind the bars.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sonpur P.S. Case No. 353 of 2023.
