JUSTICE ARUN KUMAR ORAL ORDER 06-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody seeks bail in Samastipur (Muffasil) PS Case No. 123 of 2018 registered under Sections 341, 323, 354(A), 354(B), 387, 448, 504 and 506/34 of the IPC. The allegation in brief is that the petitioner used to abuse the informant in inebriated condition, demanded extortion money and caught hold hands of female of the house.

Learned Counsel for the petitioner submits that both sides are next door neighbours, there is dispute of drainage and passage between the two houses and on account of that this case was lodged, the FIR discloses date of occurrence as 2.3.2018 but the written information was given after lapse of three days and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Bambam Yadav @ Vimal Kumar Bambam is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM V, Samastipur in connection with Samastipur (Muffasil) PS Case No. 123 of 2018.
