2. The petitioner apprehends his arrest in a case in connection with Sathi P.S. Case No. 74 of 2023, registered for the offences punishable under Sections 356, 379 of the Indian Penal Code.
3. As per F.I.R., allegation against the petitioner is of looted the cash and mobile from the informant.
4. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Petitioner has got no criminal antecedent mentioned in Para 3 of the bail application. He submits that petitioner is not named in the F.I.R. and the F.I.R. is lodged against unknown
Patna High Court CR. MISC. No.84529 of 2023(2) dt.12-01-2024 2/2 person. He further submits that police has arrested one person namely Shyam Sunder Mahto from which the mobile was recovered. He further submits before the police that he had purchased mobile from the said Deepak Mishra and Sheikh Nizamuddin and Shyam Sunder Mahto disclosed the name of the petitioner. He further submits that petitioner is a student of Intermediate and examination is going to be held from 10.01.2024 to 21.01.2024.
5. Learned APP for the State has opposes the prayer for bail.

Having regard to the facts and circumstances of the case and also petitioner has no criminal antecedent, let the above named petitioner, be released on bail, in the event of his arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with Nautan Sathi P.S. Case No. 74 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
