JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-07-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially registered for the offences punishable under Sections 341, 323, 504, 34 of the Indian Penal Code and later on, Section 307 of the Indian Penal Code was added.

Petitioner is said to have given single lathi blow on the head of the informant.

The alleged occurrence appears to have taken place on account of petty dispute and moreover, first information report was lodged after three days of the occurrence. Although, the learned court below has observed in the

No.43605 of 2018 (2) dt.20-07-2018 2/2 impugned order that informant sustained grievous injury but considering the aforesaid facts and circumstances as well as taking note of this fact that petitioner is in jail custody since 28.05.2018, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Muffasil P.S.
