The petitioner is apprehending his arrest in connection with Ballia P.S.Case no.107 of 2017 registered for offences punishable under Sections 147, 148, 149, 447, 323, 325, 337, 338, 379, 307, 504 of the Indian Penal Code.

Submission of the learned counsel for the A.P.P. is that in this case already the processes under Section 82 and 83 have been issued, as such the petitioner should move for regular bail. It is submitted on behalf of the learned counsel for the petitioner that another co-accused having similar allegation has been granted privilege of anticipatory bail.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before

Patna High Court Cr.Misc. No.39751 of 2018 (2) dt.06-09-2018 2/2 the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record and also considering the fact that another co-accused has been granted privilege of anticipatory bail by this Court.

With the aforesaid observation, this application is dismissed.
