This is an application for grant of anticipatory bail in connection with Chanpatia P.S. Case No. 194 of 2019 registered for the offence punishable under Sections 341, 323, 354(A), 354(B), 457, 380, 504, 506 and 34 of the Indian Penal Code. The allegation is regarding the petitioners having arrived at the house of the informant and abused her, as also are stated to have removed her clothes above her waist.
The learned counsel for the petitioners submits that admittedly, there is a land dispute and the petitioners have been falsely implicated in the present case, which is apparent from
Patna High Court CR. MISC. No.72825 of 2019(2) dt.20-11-2019 2/2 the tenor of the FIR lodged by the informant. It is further submitted that at the time when the present case was instituted, the petitioners were having a clean antecedent. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Chanpatia P.S. Case No. 194 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
