The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Prosecution case as lodged by the informant is that he is owner of transport company namely Rajashthan Panjab and Hariyana Transport. On 06.09.2019 his relative namely Rajesh Kumar along with 4/5 persons came and one of them namely Parikshit Bind recognized himself to be owner of a truck bearing No. BR06GA-4358. It is alleged that on reorganization of his relative Rakesh Kumar informant has authorized the truck to loaded wheat from the Laxmi Trading Bhabua where he has loaded 430 bags wheat total weight 25.15 quintal and informant consigned the same wheat to Jagarnath Rice Mill and flower

Patna High Court CR. MISC. No.72491 of 2019(2) dt.25-11-2019 2/2 mill Bhuneshwar but later on his relative Rajesh Kumar informed him that unknown persons has given some intoxication injection to truck driver and cleaner and taken away truck loaded wheat.

Learned counsel for the petitioner submits that petitioner is neither named in the FIR nor any incriminating article was recovered from his possession or house. He further submits that name of the petitioner has come on the confessional statement of one Rakesh Kumar Bind. He submits that petitioner has no criminal antecedent as stated in para-3 of the bail petition and he is languishing in judicial custody since 14.09.2019. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua Police Station Case No. 551 of 2019, G.R. No. 2028 of 2019).
