JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-03-2020 The petitioner seeks bail in connection with Sonepur P.S. Case No. 368 of 2019 dated 25.05.2019 instituted for the offences under Sections 341, 323, 325, 307, 354B, 504, 506 and 34 of the Indian Penal Code and under Section 27 of the Arms Act in which he is in custody since 20.08.2019.

It appears from the accusation in the FIR that one Shrawan Kumar Singh @ Phukan started playing vulgar songs on the occasion of marriage of the daughter of the informant. When this was objected to by the ladies of the house, the entire family members of the informant were threatened by the petitioner and others. When this was protested, co-accused Anil Singh is said to have assaulted the sister-in-law of the informant by means of a butt of a pistol. The petitioner

Learned counsel for the petitioner has submitted that this false accusation has been levelled against the petitioner because of earlier dispute. The petitioner is the co-villager of the informant and earlier also, because of some petty disputes, three cases were lodged against him at the instance of the informant and other members of his family. In the list of cases provided in paragraph-3 of the bail petition, the petitioner has been granted bail in all of them. Regard being had to the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1, Saran at Chapra in connection with Sonepur P.S. Case No. 368 of 2019.
