ANJANA MISHRA ORAL ORDER 19-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.03.2018 in connection with Bagen Gola P.S. Case No.07 of 2018 registered for the offence under Sections 147, 148, 149, 307 and 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that there is no specific overt act attributed to the present petitioner and he is only present at the place of occurrence. It is further submitted that similarly situated co-accused, namely, Vijay Mushar @ Vijay Musahar @ Vijay Ram and Manju Mushar @ Manju Musahar, have been granted bail in Cr.Misc. No.37459 of 2018 vide order dated 04.07.2018 and co-accused Rajendra Mushar @
Patna High Court Cr.Misc. No.42504 of 2018 (2) dt.19-07-2018 2/2 Rajindra Musahar and Ravindra Mushar, have been granted bail in Cr. Misc. No.38797 of 2018, vide order dated 10.07.2018. Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Buxar, in connection with Bagen Gola P.S. Case No.07 of 2018.
