The petitioner apprehends his arrest in connection with Complaint Case (POCSO) NO. 36 of 2019 for the offence punishable under Sections 323, 341, 354, 452/34 of the Indian Penal Code and Section 3⁄4 of the POCSCO Act. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, there is a dispute with regard to a friendly loan between the parties and on account of the same, this false case has been lodged

Patna High Court CR. MISC. No.72667 of 2019(2) dt.31-01-2020 2/2 by the informant, which is evident from Annexure-3. Moreover, the matter has been compromised between the parties and an affidavit to that effect has also been filed, which is evident from Annexure-4. Hence, the petitioner may be granted the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the, above named, petitioner in the event of his arrest or surrender before the court below within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-1 -cum- Special Court (POCSO), Saran in connection with Complaint Case No. 36 of 2019 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
