Learned counsel for the petitioner submits that against the impugned action the petitioner has filed an appeal before the Deputy Director General of Military Police, North Division, Muzaffarpur and the same is pending.

Learned counsel for the petitioner submits that Appellate Authority should be directed to consider the case of the petitioner and take decision in accordance with law.
