JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Mokama P.S. Case No. 120 of 2018 for the offence under Sections 30(a), 38, 37 (b) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and they are in custody since 15.05.2018. Learned counsel submits that other co-accused, namely, Ranjit Kumar, has been granted bail vide order dated 28.06.2018 in Cr. Misc. No. 36472 of 2018 and Umesh Chaudhary has been granted bail vide order dated 02.07.2018 in Cr. Misc. No. 38377 of 2018.

Considering the fact that the similarly circumstanced

No.40323 of 2018 (2) dt.10-07-2018 2/2 co-accused have been granted bail and the petitioners have remained in custody for nearly two months, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Patna in connection with Mokama P.S. Case No. 120 of 2018 (Special Case No. 4581 of 2018).
