The petitioner, who is in custody, seeks bail in connection with Jamhore P.S. Case No. 19 of 2018 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 504, 307 of the Indian Penal Code and Section 27 of Arms Act. Informant Rupa Devi in her fardbeyan has stated that on 18.02.2018 Tilak was being performed in her house at about 9.30 PM. When her neighbour came and tried to disturb the Tilak function which was being performed in a customary manner. At 10 'o' clock all the five accused variously armed came there and at the instigation of petitioner and other three accused, Munna Sah fired upon the husband of informant.
Patna High Court Cr.Misc. No.40604 of 2018(2) dt.12-07-2018 2/2 Allegation against the petitioner and other three co-accused is of giving order to fire upon the husband of the informant. It has been submitted on behalf of counsel for the petitioner that he is innocent and has been falsely implicated in this case and has no criminal antecedent. It has been further submitted that similarly situated persons have already been granted bail by this Court as contained in Annexure-2 to this application. He is in custody since 19.04.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad, in connection with Jamhore P.S. Case No. 19 of 2018.
