Petitioner seeks bail in Ram Nagar P.S. Case No.113 of 2018 instituted for the offence under Section(s) 25(1) (a) (b), 26 Arms Act and Section 120(B) of Indian Penal Code. Counsel for the petitioner submits that there is no recovery of any incriminating article from his possession. Police has recovered country made Katta and one live cartridge from the tractor of one Jai Prakash Kushwaha but he has not been made accused in this case. Police has arrested this petitioner and recorded his confessional statement. He is said to be in custody since 13.05.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

Patna High Court Cr.Misc. No.42173 of 2018 (3) dt.24-09-2018 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Ram Nagar P.S.
