Petitioners seek bail in a case registered for the offences punishable under Sections 364 and 302/34 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of C.L.A. Act.
Murder of the husband of the informant was committed by the Naxals.
Submission is that only suspicion is there against the petitioners. No one had seen the petitioners committing the crime. Co-accused-Ajay Yadav has already been allowed bail by a Coordinate Bench of this Court vide order at Annexure-3.
Patna High Court CR. MISC. No.81148 of 2019(3) dt.18-03-2020 2/2 Investigation of the case is already complete. Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Madanpur Police Station Case No.274 of 2018(G.R.Case No.1943 of 2018), subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the trial of the case as well as petitioners shall not leave the country without permission of the learned Trial Court, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
