The petitioner has been in custody since 16.04.2018 in connection with Naugachhia Rail P.S. Case No. 40 of 2017 registered for the offences punishable under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that he has been falsely implicated in the present case and nothing has been recovered from the conscious possession of the petitioner, but the name of the petitioner transpired as he was found to be using the mobile phone. It is further submitted that the petitioner is a labourour and working at Ludhiana and the SIM may have been used by some unknown persons to which he does not claim knowledge. It is next submitted that no T.I. Parade has been held to identify the petitioner, as he was travelling in the train along with the informant, he could

In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Railway, Khagaria in connection with Naugachhia Rail P.S. Case No. 40 of 2017.
