2. The petitioners apprehend their arrest in a case in connection with Ghosi (Okari o.p.) P.S. Case No. 169/2023, registered for the offences punishable under Sections 304 (B)/34 of the Indian Penal Code and under Section 3/4 of the D.P. Act.

3. As per F.I.R., allegation against the petitioners are of assaulting the informant's daughter as a result she died during treatment.

4. It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in the present case. Petitioners have got no criminal antecedent mentioned in

Patna High Court CR. MISC. No.83713 of 2023(2) dt.09-01-2024 2/2 Para 3 of the bail application. Petitioner no. 1 is Bhaisur whereas petitioner no. 2 is married Nanad of the deceased and the husband of the deceased is already in judicial custody since 22.07.2023 mentioned in Para 9 of the bail application.

5. Learned APP for the State has opposes the prayer for bail.

Having regard to the facts and circumstances of the case and also there is no specific overt act against the petitioners, let the above named petitioner, be released on bail, in the event of their arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with Ghosi (Okari o.p.) P.S. Case No. 169/2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) Ranjeet/- U T
