2. Earlier the prayer of bail of this petitioner was rejected vide order dated 22.05.2023. This is second attempt of bail.

3. The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code and Section 27 of Arms Act.

4. The petitioner is accused of snatching Rs. 4 lakh from the informant and shot him by fire arm which hit the informant on the back of this shoulder. The petitioner is in jail since 31.03.2022.

5. At the outset, learned counsel for the petitioner, without accepting the guilt of the petitioner, has submitted that the petitioner is ready to compensate the informant by paying an amount of Rs. 1 lakh in the Court below

6. Learned counsel for the State has opposed the prayer for bail.

7. Considering the period of custody and undertaking made by the petitioner, this application is allowed.

8. Let the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 03 of 2022.

9. At the time of furnishing the bail bonds, the petitioner shall furnish a demand draft of Rs. 1 lakh prepared in the name of the informant. If the petitioner furnishes the demand draft of Rs. 1 lakh, the Court below shall accept the bail-bonds of the petitioner and hand over the said demand draft to the informant.

10. The petitioner shall mark his presence in Lalganj Police Station, Distt- Vaishali at Hajipur, on 1st Sunday of every week, failing which, the bail bonds of the petitioner would be cancelled.
