The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 457, 461, 379, 380, 411 of the Indian Penal Code.

As per allegation in the FIR, when informant reached his quarter, he saw the lock is broken and items of the room are lying on the ground. It is further alleged that some miscreants are apprehended with thef articles. From the possession of petitioner, Aadhar card, Driving license, ATM Card, ID Card of bihar police of the

Patna High Court CR. MISC. No.83986 of 2023(2) dt.08-01-2024 2/3 informant and other articles along with Rs. 3,500/- were recovered.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Petitioner has no concern with the alleged offence or with the other co-accused persons. It is further submitted that police personnel has implicated the petitioner in this case showing his ID card in his possession. Moreover, the petitioner is languishing in judicial custody since 17.08.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on
