Petitioner seeks bail in Sessions Trial No. 105 of 2018 arising out of Vijaypur P.S. Case No. 94 of 2017 registered for the offence punishable under Sections 394 and 302 of the Indian Penal Code.

Informant in his written complaint has stated that when he was returning after attending marriage ceremony then three unknown miscreants stopped him and started snatching the motorcycle of the Informant and when the Informant protested then one of the miscreants gave knife blow on account of which Informant fell down and they looted away the motorcycle. Informant died in course of treatment.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.43055 of 2018(3) dt.24-09-2018 2/2 he is innocent and has been falsely implicated in this case. FIR is against unknown.

Considering the fact that on the disclosure of petitioner knife which was used by him in stabbing the Informant was recovered, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.

However, the trial court is directed to expedite the trial of the petitioner and conclude the same within a period of one year from the date of receipt/production of a copy of order passed by this Court.
