2. The petitioner is in judicial custody in connection with SC/ST P.S. Case No. 36 of 2024 for the offence punishable under Sections 126, 115(2), 352, 74, 351(4), 351(2) of B.N.S. and 3 (i)(r)(s)(w)3(2) (Va) of ST/SC Act and 8/12 of POCSO Act lodged on 06.07.2024 by the informant, Reeta Devi.
3. As per the prosecution story, the informant who is the mother alleged that having found her daughter alone, this petitioner tried to outrage the modesty. Upon alarm raised by her, the informant reached there and saved her. Upon knowledge of it, the FIR.
4. It is the case of the petitioner that due to dispute
Patna High Court CR. MISC. No.84253 of 2024(2) dt.11-12-2024 2/2 regarding "Rasta", the false narration in the FIR and later both the parties have filed compromise also.
4. Learned APP on the other hand has pointed out the FIR allegation and further submits that the girl is only 13 years of age and specific allegation of not only outraging the modesty but he has also touched private parts of the girl.
5. Considering the aforesaid submission that has come on record as also the allegation in the FIR, for the present, this Court is not inclined to extend him the privilege of bail with conditions.
6. The bail application stands rejected.
