The petitioners apprehend their arrest in connection with Barharia P.S. Case no. 304 of 2019, registered under Sections 448, 341, 342, 323, 324, 379, 308, 380 and 504/34 of the Indian Penal Code.

The accusation is that on 19.08.2019, while informant Vijay Chandra Rai was sitting at his door, in the meanwhile, petitioners along with Upendra Yadav came there armed with various weapons and they surrounded Arjun Yadav, brother of the informant, and started abusing and assaulting him. When informant and his other family members rushed

At that time, Upendra Yadav and Surendra Yadav (Petitioner No. 3) caught hold the informant and snatched gold chain from his neck. Learned counsel for the petitioners submits that occurrence of Marpit took place due to land dispute in which petitioners side also sustained injuries regarding which Barharia P.S. Case No. 303 of 2019 was instituted by the Surendra Kumar against the informant and others of the present case. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Barharia P.S. Case No. 304 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
